1. Scope

1.1. These general terms are applicable to the by SkiWebShop, Laagsteen 37, 4815PH Breda (hereafter: “Provider”) organized giveaway ‘Gewinnen Sie ein Strandtuch’ (hereafter: “giveaway”) for the promotion of SkiWebShop

1.2. To be eligible to enter the giveaway the Contestants must be a real person, at least 18 years old and permanently reside in the Netherlands, Belgium or Germany (herafter: “Contestant”)

1.3. The giveaway will be held up to and mid August.

1.4. The promoter reserves the right to terminate, interrupt or modify the promotional campaign, at its own discretion and without any prior notification, and/or to change the Terms and Conditions governing Promotional Campaigns and/or the prizes, if circumstances arise rendering this necessary, without being obliged in any way to indemnify Contestants.

1.5. The Terms and Conditions have been translated from Dutch to English as a courtesy. In the event of differences of interpretation, the Dutch version shall prevail and shall be binding between the Parties.

 

2 Participation

2.1. To enter the giveaway you have to leave your email address in the correct form.

2.2. Only one entry will be accepted per person. Multiple entries from the same person will be disqualified.

2.3 Participation is free of charge.

2.4. If the contestant does not meet the eligibility requirements or is subject to any entry restrictions, that Contestant shall not be entitled to be adjudged a winner, and will not be entitled to a prize in any circumstances.

 

3. Winners and prizes

3.1.1 If contestant is permanently residing in the Netherlands or Belgium they have a chance in winning a bath towel with the text: ‘Ik lig liever in de sneeuw. #helemaalklaarmee’

3.1.2 If contestant is permanently residing in Germany they have a chance in winning a bath towel with the text: ‘Ich wäre jetzt lieber im Schnee. #vielzuwarm’

3.2 Competition prize winners will be notified of the competition result by email (if address is asked for/provided) not more than 30 days following the closing date of the competition, and will receive their prizes not more than 60 days following that closing date.

3.3 Reasonable efforts will be made to contact the prize winner for 7 days but if the winner fails to respond to our notification attempts within this time or provide an address for delivery of the prize or fails to meet any of the eligibility requirements or is otherwise unable to comply with the competition terms and conditions, we reserve the right to disqualify that Contestant and offer the prize to the next eligible Contestant and thereafter until a winner is found.

3.4 No cash alternative to the prizes will be offered. The prizes are not transferable. Prizes are subject to availability and we reserve the right to substitute any prize with another of equivalent value without giving notice.

 

4. Copyright and moral rights

4.1 You warrant to us that you created your competition entries, that you own all of the copyright in those entries, and that our use of the entries in accordance with these rules will not infringe any person's intellectual property rights or other legal rights.

4.2 You grant to us, SkiWebShop, an exclusive, worldwide, royalty-free, perpetual and irrevocable licence to copy, store, edit, distribute, transmit and publish everything that is related to the giveaway, i.e. photographs and names on our website, our social media pages and the newsletter of SkiWebShop.

4.3. By entering this contest, the Contestant consents to the Providers and its service providers using and processing the Contestant’s personal data in connection with the contest and in accordance with Providers privacy policy or otherwise as required by law or regulation. In addition, the Contestant permits the Providers to use the Contestant’s personal data for any commercial purpose and to publish the Contestant’s submissions and/or his personal data in various media for publicity purposes. Prizes are subject to winners taking part in or cooperating with the Providers in relation to related publicity and providing a photograph for publication and/or taking part in further promotional activities.

 

5. Liability

5.1. By entering you agree to release and hold harmless SkiWebShop and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such contestant’s participation in the giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries.

5.2. If, despite the stipulations in paragraph 5.1, the Provider’s liability for damages suffered by a Contestant must be accepted the Provider’s obligation to reimburse the damages in question remains limited to the amount the Provider’s insurance company will pay in respect of the claim.

5.3. Provider is not liable for damages caused for example the loss or the misplacement of contestant’s information.

 

6. Disputes

6.1. This giveaway is governed by the laws of The Netherlands, excluding the Vienna Trade Treaty. As a condition of participating in this Giveaway, Contestant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, exclusively before a court located in The Netherlands having jurisdiction. Further, in any such dispute, under no circumstances will Contestant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than Contestant's actual out-of-pocket expenses (i.e. costs associated with entering this Giveway), and Contestant further waives all rights to have damages multiplied or increased.

6.2. This Giveaway is organized in accordance with the Code of Conduct for promotional games of chance

6.3. There will be no further communication regarding the results of the contest. If the Terms and Conditions do not provide the answer, the Provider makes the decision.

6.4. As mentioned in paragraph 1.5 the Terms and Conditions have been translated from Dutch to English as a courtesy. In the event of differences of interpretation, the Dutch version shall prevail and shall be binding between the Parties.
